1. Who processes your data

2. What this policy covers — and what it does not
It covers: the personal data this site collects, for which we are the controller.
It does not cover: data processed by our customers through the software we license.
Our software is delivered as a binary and runs entirely within the customer’s infrastructure. Data processed there is not transmitted to us, is not accessed by us, and does not pass through our systems. In respect of that data, the customer is the controller and we act neither as controller nor as processor. The conditions are set out in the MSA.
If you are a user or employee of a company that uses our software, your data is with them, not with us — and requests should be directed to them.
3. Applicable law
Although we are based in Paraguay, data protection law may apply to us extraterritorially where we offer goods or services to, or process data of, individuals located in another jurisdiction. Where that is the case — including under Brazil’s Law No. 13,709/2018 (LGPD) and the EU GDPR — we observe the applicable regime for the activities described in this policy.
4. Data we collect
4.1. Provided by you, through the contact form or by email: name, work email, company, and the content of the message you send us.
4.2. Collected automatically: none. This site uses no cookies, no analytics tools, no pixels and no third-party trackers, and loads no resources from other domains. The hosting provider may keep technical access logs — IP address and request data — under its own retention policy, for security and service stability; we do not use them for analytics, profiling or advertising.
4.3. We do not collect sensitive personal data through this site, and we ask that sensitive personal data and data concerning third parties not be included in messages you send us.
4.4. We do not carry out automated decision-making with legal effects concerning you, nor profiling for advertising purposes.

6. Sharing
We share data only with providers that support the operation of this site, acting as processors on our behalf and limited to the purposes above: hosting provider, email service, form tooling, and the payment processor where an engagement exists.
We do not sell your data and do not share it with third parties for advertising.
We may disclose data upon order of a competent authority, notifying you in advance where legally permitted.
7. Processing in other countries
We operate internationally. Your data may be processed and stored in countries other than the one you are in, including by us and by the providers listed in section 6.
Regardless of where processing takes place, we apply to this policy and to our relationships with providers contractual and technical safeguards intended to maintain a level of protection equivalent to that required by the law applicable to you, including data protection contractual clauses and security and access controls.

8. Retention
- Enquiries without an engagement: 12 months after the last interaction. A new interaction from you restarts the count.
- Customers: for the term of the contract and thereafter for the period required by applicable tax and civil law.
- Browsing records: we generate none (section 4.2). The hosting provider’s technical logs follow its own retention policy.
Once those periods end, data is deleted or anonymised, save where the law requires retention.
9. Security
We apply technical and organisational measures appropriate to the nature of the data: HTTPS transmission, access restricted to what is necessary, strong authentication on administrative accounts, and periodic access reviews.
No system is entirely immune. In the event of a security incident presenting relevant risk, we will notify affected individuals and the competent authority within the applicable timeframes.
10. Your rights
You may at any time request: confirmation that processing takes place; access to your data; correction of incomplete or outdated data; anonymisation, blocking, or deletion of unnecessary data or data processed in breach of the law; portability; information about sharing; withdrawal of consent; and objection to processing based on legitimate interests.
How to exercise them: write to contact@actahost.com. We will respond within the applicable statutory period. We may request information to verify your identity before responding.
You may also lodge a complaint with your competent supervisory authority.
11. Cookies
This site uses no cookies — no session cookies, no analytics cookies, no third-party cookies. Nothing is stored in your browser. If that changes, this policy will be updated before the change goes live.
12. Changes
We may update this policy by publishing the new version on this page with the date of the update. Material changes will be communicated through the available channels.
